By Emily Field (October 4, 2021, 10:18 PM EDT) — Seven legal and trade groups urged the U.S. Supreme Court on Monday to take up Bayer AG’s appeal of a Ninth Circuit ruling that awarded $25 million over claims that its Roundup weedkiller causes cancer, arguing that the appellate court allows unreliable experts.
The amicus briefs follow Monsanto’s July petition for certiorari, in which the Bayer unit argued that the high court should review the ruling because plaintiff Edwin Hardeman’s state failure-to-warn claims are preempted by federal law and that his expert witnesses were allowed to testify about the weedkiller’s safety without basis.
